Survey: Insiders the biggest threat to intellectual property

A new survey released today found that more than half of enterprises believe that the biggest threat to their sensitive information is through the action of malicious or negligent insiders—be they employees, outsourced workers or others working with trusted partners.

The results of the survey were published in an Enterprise Strategy Group brief titled "Intellectual Property Rules" as part of research conducted on behalf of Reconnex. In the report, analyst Eric Ogren noted that the insider threat is a risk not just to personally identifiable information, but also to the myriad of other types of intellectual property (IP) that businesses must protect daily.

"One of the surprises (we found) is how many different forms of IP of there are out there that companies are worried about protecting," Ogren told SCMagazine.com.

Question: I think I understand what are Patent, Trademark, and Copyright.
But I have a question as to what I can do with the following: “X”


TO PROTECT MY IDEA OR “X” I WILL PROVIDE OTHER EXAMPLES:

Example 1:
Let take a Purse. A bag. Which is mostly for woman. So, we can say a Woman’s Bag, Woman’s Purse, or Female Purse. I know I can Trademark a Name of a product but that is not what I am talking about.

Now “X” equals a Man’s Bag or Purse. The idea of Bag or Purse is not new and the designs of a purse are endless. SO, lets say the “idea” or “X” is for a man to use a Bag.

Let say I want to produce and market “Man Bag” and “Man Purse” or “Male Bag”

What would I do or can do? Can I Patent, trademark, or Copyright “X”.

How can I stop other form marketing “Man Bag,” not a “Name” but the “idea” of Man using a Bag? Or for some other company to sell and promote, and market the idea of men’s bag.




Example 2:
The world of pro-basketball is male and female. The world of pro-football is male.

In basketball the “Ball” is the same for both. In football the ball for a male since the game is technically all male.

Let say I want to produce a smaller size basketball and or football and maybe colored pink or yellow or with flowers; however this is not the point or the idea. I want to market the “ideas” the “X” and that is “Women’s Football” or “Female Football” and I am not talking about the ball. I am talking about the idea that there is a Football for women.

Others can produce and sell football any size or color they want; but can I stop them from selling it as a football for a Women or Female’s football?



Example 3: (I know this is a crazy example but it will help)
Lets go back to a world when men wear pant and women wear dresses. The “X”, the idea is “Women’s pants” or “Female Pants.”

So, can I Patent, Trademark, or Copyright the “Idea” and can I keep other from selling pant as Female pants?
